Terms of Service

These Terms of Service (“Terms”) govern your use of voxitect.com (the “Service”), operated by Yildirim Yazganarikan (“we”, “us”, “our”). By using the Service you agree to these Terms.

1. The Service

The Service is a free, browser-based architectural design tool. It is offered as a free preview during ongoing development. Features, availability, and performance may change without notice. We may add, modify, or remove features at any time.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed these Terms on your behalf.

3. Your content

Anything you design, create, or save using the Service (“Your Content”) is yours. We do not claim ownership of Your Content.

Your designs are stored locally in your browser by default. You are responsible for backing up Your Content. We are not responsible for any loss of Your Content caused by browser data loss, cache clearing, device failure, or anything else.

If you choose to export or share Your Content (for example by downloading an image or video, or publishing a render), you remain responsible for how that content is used.

4. Acceptable use

You agree not to use the Service to:

• violate any law or the rights of any third party;
• reverse engineer, decompile, or disassemble the Service except to the extent permitted by law;
• attempt to gain unauthorised access to any portion of the Service or its underlying systems;
• interfere with or disrupt the Service or the servers and networks supporting it;
• generate content that is unlawful, harassing, defamatory, or that infringes any third party’s intellectual property or privacy rights.

We may suspend or block access to the Service at any time for any reason, including a good-faith belief that you have violated these Terms.

5. Intellectual property

The Service, including its code, design, copy, logos, and underlying technology, is owned by Yildirim Yazganarikan and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of the Service, or use it to build a competing product, without our prior written consent.

6. Third-party services

The Service relies on third-party services (such as hosting and webfonts) that have their own terms and policies. Your use of those underlying services is also subject to their terms.

7. AI-generated content

The Service may include features that use artificial intelligence — for example, photorealistic rendering of your designs. AI output may be inaccurate, incomplete, or unexpected. You are responsible for reviewing AI output before relying on it. We do not warrant that AI output is free of errors, suitable for any particular purpose, or non-infringing.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure.

The Service is a design and visualisation tool. It is not a substitute for professional architectural, engineering, structural, or regulatory review. Any model, plan, or render produced using the Service is for illustrative purposes only and should not be used for construction without review by a licensed professional.

9. Limitation of liability

To the fullest extent permitted by law, in no event will Yildirim Yazganarikan, his affiliates, employees, or contributors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or designs, arising out of or related to your use of the Service.

Our aggregate liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100), or the amount you have paid us for the Service in the 12 months preceding the claim, whichever is greater.

Some jurisdictions do not allow these limitations, so they may not apply to you in full.

10. Indemnification

You agree to indemnify and hold Yildirim Yazganarikan and his affiliates harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. The provisions of these Terms that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. You and Yildirim Yazganarikan agree that any legal dispute relating to the Service will be brought exclusively in the state or federal courts located in San Francisco County, California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Changes to these terms

We may revise these Terms from time to time. The “Last updated” date reflects the most recent revision. Material changes will be highlighted on this page. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
